Please read these Terms of Service carefully before using the Ximple website or applying for any Ximple financial products. By accessing our website or submitting a credit application, you agree to be bound by these Terms.

1. Company Information

These Terms govern your use of the website located at ximple-mx.com and the financial services provided by:

Ximple is a SOFOM E.N.R. authorized to operate under the LGOAAC, supervised by the CNBV pursuant to Article 56 thereof. Our operations are subject to applicable Mexican financial law and regulation.

2. Eligibility

To apply for Ximple financial products, you must:

  • Be at least 18 years of age
  • Be a Mexican national or legally authorized to operate a business in Mexico
  • Have a valid RFC registered with the SAT
  • Operate or own a small or medium-sized business in Mexico
  • Provide accurate, complete, and truthful information in all applications and communications with Ximple

Ximple reserves the right to verify eligibility requirements and to decline any application at its sole discretion, subject to applicable anti-discrimination laws.

3. Financial Products and Services

Ximple offers the following financial products, subject to individual credit approval:

  • Ximple Card: A revolving business credit card with a credit limit determined by our credit evaluation process
  • Ximple Instant Loan: A fixed-term business loan with weekly repayment schedule

The specific terms governing each financial product — including credit limits, interest rates, fees, repayment schedules, and CAT — are set out in the individual credit agreement executed at the time of approval. In the event of any conflict between these Terms of Service and a credit agreement, the credit agreement shall prevail.

4. Interest Rates, Fees, and CAT

Interest rates, commissions, and other charges applicable to Ximple financial products are disclosed in the pre-contractual information provided at the time of application and confirmed in your credit agreement. As required by CNBV regulations:

  • The Costo Anual Total (CAT) is provided for informational purposes and represents the standardized annual total cost of credit
  • CAT Promedio Informativo: 223% sin IVA. Sujeto a cambios.
  • Actual rates may differ based on your individual credit profile and product type
  • There is no annual membership fee for the Ximple Card

5. Repayment Obligations

You agree to repay all amounts borrowed under Ximple credit facilities in accordance with the repayment schedule set out in your credit agreement. Failure to make timely repayments may result in:

  • Accrual of default interest at the rate specified in your credit agreement
  • Reporting of delinquency to credit bureaus (Buro de Credito and Circulo de Credito)
  • Suspension or cancellation of your credit facility
  • Collection proceedings in accordance with applicable Mexican law

6. Website Use

You may use the Ximple website for lawful purposes only. You agree not to:

  • Use the website for any fraudulent or unlawful activity
  • Submit false or misleading information in any application or inquiry
  • Attempt to gain unauthorized access to any part of the website or its underlying systems
  • Engage in any activity that could damage, disable, or impair the website's functionality
  • Reproduce, distribute, or commercially exploit any content from the website without our written permission

7. Intellectual Property

All content on the Ximple website — including text, images, logos, graphics, software, and code — is the property of Finanzas Embebidas Ximple, SOFOM E.N.R., or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Ximple's trademarks, logos, or other brand elements without our express written consent.

8. Disclaimer of Warranties

The Ximple website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or harmful components. Financial information and calculators on the website are provided for illustrative purposes only and do not constitute a binding credit offer.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ximple shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the website or our services. Our total liability for any claim related to these Terms shall not exceed the amounts paid by you to Ximple in the 12 months preceding the claim.

10. Consumer Protection

These Terms are subject to applicable Mexican consumer protection laws, including the Ley de Proteccion y Defensa al Usuario de Servicios Financieros (LPDUSF). If you have a complaint about our financial services, you may contact CONDUSEF (condusef.gob.mx) or call 800-999-8080.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Mexico. Any disputes arising from or relating to these Terms shall be resolved by the competent courts of Mexico City (Ciudad de Mexico), with each party waiving the right to rely on any other jurisdiction.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting updated Terms on the website with a revised effective date. Your continued use of the website or Ximple services after such changes constitutes acceptance of the revised Terms.
